The Silent Partner Free Trial Terms and Conditions

A Silent Partner Free Trial is bound by terms set out in The Silent Partner General Terms and Conditions as well as the terms and conditions found on this page.

Definition

The Silent Partner offers certain services on a trial basis at no charge.

Purpose

The purpose of a Free Trial is to test the quality and performance of the services offered by The Silent Partner. A Free Trial is not intended to be used for any other purpose and may be, at any time and without notice, terminated and subject to fees and charges if it is suspected that it is.

Duration

The duration of a Free Trial is capped at the Free Trial Period. The Free Trial Period is 7 days unless clearly stated otherwise in writing.

Period

The services under the Free Trial will be made available to the customer on the day the service is established, however The Free Trial Period will commence on the next business day and will conclude at Close of Business on the last day of the trial period.

Concessions.

No concessions are made for weekends, bank or public holidays.

Utilization

The customer is to make full utilization of the Free Trial during the Free Trial Period within the terms and conditions set out in this agreement. The Free Trial Period will NOT be extended in the event that The Customer has failed to utilize the services made available to it during the Period.

Extensions

The Silent Partner is under no obligation to extend The Free Trial Period for any reason. The customer may request an extension to the Free Trial Period in writing and not within 2 business days of the conclusion of the Free Trial Period. An extension may be granted only on extenuating circumstance.

Holiday Period

The Silent Partner does NOT offer a Free Trial of any service during the Holiday Period of December and January.

Termination by The Silent Partner

The Silent Partner may terminate a Free Trial at any time during the Free Trial Period for any reason, without notice and without liability. Reasons may include, but are not limited to:

  • – illegal or inappropriate use
  • – abused usage
  • – inappropriate, abusive or offensive calls
  • – not for the purpose set out in this agreement
  • – for any other reason

Termination By The Customer

The Customer may terminate a Free Trial on the basis that it can be substantiated that The Silent Partner has failed to deliver to the customer an adequate and acceptable level of service. If a Free Trial is terminated for any other reason, then The Silent Partner reserves the right to claim all fees associated with the establishment and delivery of the service based on a minimum period of one month.

Conclusion Of The Free Trial

At the conclusion of the Free Trial Period The Customer will be contacted and requested to convert the Free Trial to a paid service. Paid services shall be billed from the next calendar day following the conclusion of the Free Trial Period.

Establishment Fees

A Free Trial includes a basic service set-up and does not include any customisation. The set-up fee is charged when the Free Trial is converted to a paid service.

Scope

  1. Call Answering Services
    • – Process: Calls will be answered by a live operator, the greeting will be announced and the call will be processed as a message or a call transfer depending on the customer’s requirements, the callers requirements and the availability of the contact.
    • – Call Limit: A Free trial includes the live answering and processing of 25 inbound calls during the Free Trial Period. Inbound calls over this cap will be answered by the voicemail system and any recorded message will be emailed to the account contact. Calls will not be blocked.
    • – Phone Number: The Silent Partner will provide a single local phone number in the area requested (phone numbers only available in Australian Capital Cities).
    • – Contacts: A Free Trial includes a single contact only, additional contacts are only available on a paid service.
    • – Answer Script: A Free Trials includes the default answer script. A custom answer script is only available on a paid service.
    • – Voicemail Greeting: A Free Trial includes the standard generic voicemail greeting. A custom voicemail greeting is only available on a paid service.
    • – Call Transfer: Call transfer is to local numbers only. Call transfer to mobile or any other number is only available on a paid service.
    • – Messaging: Email and SMS Messaging is available to the single contact listed on account for the Free Trial service.
    • – Calendar Management: Calendar Management is not available as part of The Free Trial.
    • – Faxmail: Faxmail is a service that has reached the end of it’s life and is no longer provided to new accounts by The Silent Partner. It is therefore not available as part of a Free Trial.
  2. Live Chat ServicesCurrently, The Silent Partner does not provide Live Chat Services on a Free Trial basis. A credit in lieu of a Free Trial is available upon request.
  3. Email Processing Services – Currently, The Silent Partner does not provide Email Processing Services on a Free Trial basis. A credit in lieu of a Free Trial is available upon request.
  4. Virtual Address Services – Currently The Silent Partner does not provide Virtual Address Services on a Free Trial basis. A credit in lieu of a Free Trial is available upon request.

Business Hours

A Free Trial is only available during Standard Business Hours as set out in this agreement.

Disable

the Silent Partner reserves the right to terminate or disable a free trial at any time

Limit

A Free Trial is only available once to each entity or individual. A Free Trial is not available to returning Accounts or to clients who wish to open secondary or multiple services or accounts. A credit in lieu of a Free Trial may be available upon request.

Charges

The Silent Partner reserves the right to charge the customer for excessive use of services during the Free Trial Period. Excessive use may include, but is not limited to:

  • – Extended or excessive operator time engaging with callers
  • – Excessive costs associated to long call times for transferred calls
  • – Any other services provided that have been used excessively by the customer.
